When Performance Meets Protected Right

Session Description:
It never fails – a poorly performing employee goes out on leave or files an EEOC Charge just before the decision is made to terminate his employment.  Can the company move to terminate anyway? And how does a company or a supervisor protect themselves from potential liability in that situation?  Learn why documentation and timing are the keys to preventing liability in sticky employment situations.  Get tips on how to be proactive when disciplining an employee who may also have protected rights under federal or state leave law.

Learning Objectives:

  • Get an overview of ADA and FMLA laws, as well as information on state leave laws
  • Obtain specific guidance on how to document discipline
  • Understand the importance of timing in defending a discrimination claim
  • Learn how the EEOC or a Court looks at documentation when assessing liability
  • Learn why a “legitimate business reason” protects the organization and the individual supervisor in an employee lawsuit
